Dubai Property in Your Indian Income Tax Return | Schedule FA and Rental Income

Add us as aPreferred Source

A resident Indian who owns a Dubai flat has to list it in Schedule FA Table C and pay Indian tax on its rent, since the UAE charges no personal income tax that could be credited. The Rs 20 lakh penalty relief for small foreign assets does not cover property, the FAST-DS window closes on 31 December 2026, and AY 2026-27 returns can be revised until 31 March 2027.

Is it compulsory to show your Dubai property in income tax return forms in India? The honest answer is: it depends on your residential status, not on where the rent lands or whether the UAE taxes it. A Resident and Ordinarily Resident person reports the flat every year and pays Indian tax on its rent. An NRI usually reports neither. Most problems start when people get their status wrong.

Among the Indian buyers we advise in Dubai, the most common mistake is thinking that no UAE income tax means no paperwork in India. Owners collect rent in a UAE account for years, file a short return in India and leave the foreign asset schedule blank. Nothing happens until the tax department matches overseas data with the return, and by then several years need fixing at once.

Every rule here comes from the Income-tax Act, the Black Money Act, the Finance Act 2026, the disclosure scheme rules released in August 2026 and the ITR forms for AY 2026-27. Anything that could not be confirmed was left out. Read this before you file.

Foreign Property in ITR: Schedule FA Table C Explained

To show a Dubai property in income tax return forms, use Table C of Schedule FA, the table for land and buildings held outside India. An ordinary resident who owns property abroad must file a return every year, even when total income is below the taxable limit.

Which ITR Form to Use for Foreign Property

Only ITR-2 and ITR-3 have Schedule FA. Use ITR-2 if your income is from salary, rent, capital gains or other sources, and ITR-3 if you also have business or professional income. ITR-1 and ITR-4 cannot be used by anyone who holds an asset outside India.

Schedule FA Table C Details for a Dubai Flat

  • Country name and code, entered as the United Arab Emirates
  • Full address of the property and its ZIP code
  • Type of ownership: direct, beneficial owner or beneficiary
  • Date of purchase
  • Total investment at cost, in rupees
  • Income from the property and its type, such as rent
  • Amount of that income taxed in this return, with the schedule and item number where it is shown

Schedule FA Calendar Year or Financial Year

Schedule FA in the AY 2026-27 return covers assets held at any time between 1 January 2025 and 31 December 2025, while the income part of the same return follows April 2025 to March 2026. A flat bought in February 2026 is therefore not listed in this schedule; it first appears in next year's return, though any rent it earned before 31 March 2026 is taxed in this return.

Exchange Rate for Schedule FA

The investment cost in Table C is converted at the State Bank of India telegraphic transfer buying rate on the date of investment. Do not use today's rate or the 31 December rate for this figure; only the rate for the date of investment applies.

Schedule FA Applicability: Rules for Resident, RNOR and NRI Taxpayers

Schedule FA is filled only by people who are Resident and Ordinarily Resident in that year. Status is checked again every year, so the same Dubai flat can be reportable in one return and not in the next.

Schedule FA for NRI and RNOR

  • Living in India and bought through the Liberalised Remittance Scheme: almost always Resident and Ordinarily Resident, so the flat is reported and its rent is taxed in India.
  • Working in Dubai and in India for fewer than 182 days: usually an NRI, so Dubai rent is not taxed in India and Schedule FA is not filled.
  • Indian citizen living in the UAE with Indian income above Rs 15 lakh: since the UAE does not tax individuals on salary, such a person can become a deemed resident. Deemed residents are Resident but Not Ordinarily Resident, so foreign rent is not taxed in India and the schedule does not apply.
  • NRI returning to India: usually Resident but Not Ordinarily Resident for the first few years. Once you become an ordinary resident, the Dubai flat goes into Schedule FA for that calendar year.

Foreign Assets in AIS

Overseas account data reaches India from more than 100 partner countries, and since July 2026 taxpayers can see it in the new Foreign Assets Information section of the Annual Information Statement. The department says this is meant to help people file correctly, not for scrutiny. It covers bank, custody and investment accounts and their income. A Dubai flat that does not appear there still has to be reported in Schedule FA.

Dubai Rental Income Tax in India: Deductions and Exchange Rate

Rent from a Dubai flat is taxed in India as income from house property at your slab rate, and it is also shown in Schedule FSI as foreign income. The amount is worked out under Indian rules, whatever figure the tenancy contract or a UAE statement shows.

India UAE DTAA on Rental Income

Under the India UAE tax treaty, rent from property can be taxed in the country where the property is located, but this does not stop India from taxing its residents. The UAE does not tax individuals on rent, so there is no foreign tax to claim credit for, Schedule TR stays blank and an Indian resident pays the full Indian tax.

Deductions on Foreign Rental Income

Indian law allows 3 things against foreign rent: taxes charged by a local authority and paid by you, a flat 30 percent standard deduction, and interest on a loan taken to buy the flat. Dubai service charges, maintenance, agent commission and Ejari fees get no separate deduction, because the 30 percent deduction is meant to cover all running costs.

Exchange Rate for Foreign Rental Income in ITR

Under Rule 115, income from house property is converted at the State Bank of India TT buying rate on the last day of the financial year, which is 31 March. A full year of rent is converted at that one rate, not at the rate on each cheque date and not on the day you moved money to India.

Dubai Rental Income Tax Calculation Example

  • Yearly rent received: AED 90,000
  • Service charges paid: AED 14,000, with no deduction allowed
  • Less 30 percent standard deduction: AED 27,000
  • Less interest on the UAE home loan: AED 18,000
  • Taxable rental income: AED 45,000, converted at the 31 March rate and added to your other income

Under the new tax regime, if loan interest turns rental income into a loss, that loss cannot be set off against salary or any other income. For owners with large Dubai home loans, any interest above the rent is simply lost under that regime.

Foreign Asset Disclosure in ITR: Penalties for Non-Compliance

Leaving a Dubai flat out of Schedule FA is dealt with under the Black Money Act, not normal income tax rules. The penalty for not reporting a foreign asset is Rs 10 lakh for each year, and the Act also allows prosecution with jail of 6 months to 7 years.

Foreign Assets Below Rs 20 Lakh: Penalty Relief Explained

From 1 October 2024, the penalty stopped applying where the total value of unreported foreign assets other than property is up to the Rs 20 lakh limit. The Finance Act 2026 gave the same relief from prosecution. Both reliefs leave property out, so a Dubai studio of any value gets no limit at all, while a small forgotten bank account may be covered.

Black Money Act Tax on Undisclosed Foreign Property

If the flat was paid for with income never shown in India, the Act taxes its value at 30 percent and allows a penalty of 3 times that tax, a total of 120 percent of the value. The 2026 disclosure scheme was brought in to reduce this risk for smaller cases.

Income Tax Notice for Dubai Property

Overseas bank data arrives in India every year, and the UAE has also shared property ownership details. In late 2024, the tax department's foreign asset unit sent notices to around 100 Indians over Dubai homes missing from their returns. Since late September 2026, emails pointing taxpayers to the disclosure scheme have followed. They say they are not legal notices; reply by typing the e-filing portal address yourself, not through links in the email.

FAST-DS 2026: Fee, Valuation and Last Date

The Foreign Assets of Small Taxpayers Disclosure Scheme 2026 started on 16 August 2026 and accepts declarations only until 31 December 2026. After a valid declaration and payment, there is no further tax, penalty or prosecution under the Black Money Act for the declared asset.

FAST-DS Category 1 and Category 2

  • Category 1 is for a flat bought from income never taxed in India or from money whose source cannot be explained. Total undisclosed assets and income must not be more than Rs 1 crore, and you pay 30 percent tax plus an equal extra amount, which is 60 percent of the value.
  • Category 2 is for a flat bought while you were an NRI, or from savings already taxed in India, where only the reporting was missed. You pay a flat fee of Rs 1 lakh, as long as your total foreign assets are within Rs 5 crore.

A resident who sent taxed savings abroad under the Liberalised Remittance Scheme and only skipped the schedule fits Category 2, where the fee is a tenth of a single year's penalty.

FAST-DS Valuation of Foreign Property

The flat is valued as on 31 March 2026 at the higher of what you paid for it and its market price. The market price must come from a valuer recognised by the government, or a government agency, of the country where the property is located. Without such a report, the indexed purchase cost is taken as the value.

FAST-DS Form 1 Filing Process

  1. File Form 1 online with purchase documents and the valuation report.
  2. The tax officer issues a Form 2 order within 1 month from the end of the month you filed.
  3. Pay within 2 months from the end of the month you receive that order. Up to 2 more months are allowed with simple interest of 1 percent a month.
  4. File Form 3 with proof of payment. Form 4 then confirms the payment, and the immunity applies.

The scheme cannot be used for assets linked to money laundering cases or for years already assessed under the Black Money Act. Do not accept verbal confirmation from anyone that your case qualifies; check your category against your own remittance and residency records.

Missed Schedule FA in ITR: How to Correct It

The cheapest fix depends on which year was missed. For the return filed in 2026, the normal correction routes are still open. For older years, the practical routes are the disclosure scheme and the updated return.

  • AY 2026-27 not filed yet: a belated return can be filed until 31 December 2026, with a late fee of Rs 1,000 where income is up to Rs 5 lakh and Rs 5,000 above that.
  • AY 2026-27 filed without the flat: the Finance Act 2026 extended the revision window to 12 months from the end of the tax year. Revisions made after 31 December 2026 attract a fee at the same rates as the late fee above.
  • Rent left out of an earlier year: an updated return can be filed up to 48 months from the end of the assessment year, with extra tax of 25 percent to 70 percent of the tax and interest, rising with the delay.
  • Schedule FA skipped in earlier years though the money was taxed: FAST-DS Category 2 is the practical route.

This is non-negotiable due diligence for anyone who owns a Dubai flat: open every return filed since the purchase and check that the flat appears in each year you were an ordinary resident.

Buying Property in Dubai from India: LRS Limit, TCS and Off Plan Payment Plans

Indian residents can buy property abroad under the Liberalised Remittance Scheme, and the way payments are spread across Indian financial years decides how much tax is collected upfront and whether one person's yearly limit is enough.

LRS Limit for Property Abroad

Each resident can send up to USD 250,000 abroad in a financial year, and buying property is an allowed purpose. Family members can each use their own limit for a property bought in joint names, which matters when one large payment is due at handover.

TCS on Foreign Remittance for Property

Remittances for investment above Rs 10 lakh in a financial year attract TCS at 20 percent on the amount above that limit. TCS is adjusted against your Indian tax when you file, but it is not foreign tax and cannot be claimed as foreign tax credit.

Off Plan Property in Dubai: Payment Plan and Remittance Timing

A long off plan payment plan spreads remittances across several Indian financial years. For example, the published plan for Sorrento at DAMAC Lagoons asks for 5 percent on booking and 10 percent in month 1, then 6.5 percent in month 12 and 5 percent each in months 18, 24, 30 and 36, with small 0.25 percent instalments in the other months and 50 percent on completion in Q1 2030.

For studio and 1 BR apartments in DAMAC Lagoons starting at AED 680,000, the first 2 payments alone come to AED 102,000, which is already more than the TCS limit if both fall in the same financial year.

The completion payment is a different case. On that same starting price, the 50 percent completion payment is AED 340,000, about USD 92,600 at the fixed dirham to dollar rate, so a single buyer can send it within one year's limit. For a staged plan of this kind, TCS planning matters more than the remittance cap.

There is no rent to tax while the building is under construction, so in these years the tax side is mainly about TCS on remittances. Rental income and its 30 percent deduction start only after handover, once the flat is let.

Larger handover payments on Dubai off plan apartments create a different problem. In the published plan for Avenue Park Towers 2 by wasl, buyers pay 10 percent on booking and 6 instalments of 5 percent between May 2027 and December 2029, with 60 percent due at handover, estimated for June 2030. On 1 BR apartments in Wasl 1 starting at AED 1.9 million, that handover share is AED 1.14 million, about USD 310,000, which is more than one person can send in a year.

Buyers facing a handover payment above one person's yearly limit should decide co-owners before booking, so that each co-owner can send money under their own limit before the handover date.

Selling Dubai Property: Capital Gains Tax in India and Section 54

A resident who sells a Dubai flat pays Indian capital gains tax on the profit, even if the sale money stays in the UAE. If held for more than 24 months, the gain is long term and taxed at 12.5 percent without indexation. For property bought before 23 July 2024, resident individuals can instead choose 20 percent with indexation.

Section 54 Exemption on Foreign Property

Section 54 and Section 54F need the new house to be in India. A gain from selling a Dubai flat can be exempted by buying a home in India within 1 year before or 2 years after the sale, or building one within 3 years, with the exemption capped at Rs 10 crore. Selling an Indian flat to buy in Dubai gets no exemption.

Documents to Keep for Dubai Property

Keep the title deed, the sale and purchase agreement, every Form A2 and bank remittance advice, Ejari registered tenancy contracts, the bank statements where rent is received and the yearly loan interest certificate. These papers prove your Table C cost, your rent figure, your FAST-DS category and your capital gains cost if a notice ever arrives.

How This Guide Was Put Together

This guide is based on the Income-tax Act 1961 as it applies to AY 2026-27, the Black Money Act 2015, the Finance Act 2026, the FAST-DS rules and official FAQs released in August 2026, the AIS changes announced in July 2026, and the published payment plans of the 2 projects mentioned.

Before acting, check your Annual Information Statement and the scheme forms on the e-filing portal, and have a chartered accountant confirm your residential status and category for each year involved. Income earned from 1 April 2026 is governed by the Income-tax Act 2025, so form and section numbers will change for returns filed in 2027.

No estimates are used in this guide; rules that could not be confirmed were removed. The rental example uses sample dirham amounts to show the method, not market rents, and project prices and payment plans can change, so check the current version before booking.

Thinking About Investing in Dubai Property?

Frequently Asked Questions

Which ITR form is used to declare Dubai property in India?

A resident with a Dubai flat files ITR-2, or ITR-3 if there is business or professional income. ITR-1 and ITR-4 are not allowed with foreign assets. Use ITR-2 unless you run a business or practice.

Does an NRI have to show a Dubai flat in the income tax return?

No. Schedule FA in ITR is only for ordinary residents, and an NRI's Dubai rent is not taxed in India. Check your day count every year, because status can change after a long stay in India.

Is Dubai rental income taxable in India if the UAE charges no tax?

Yes, for an ordinary resident. Tax on Dubai rental income in India applies at slab rates after the 30 percent deduction and loan interest. No credit is available, so keep aside Indian tax from the rent you collect.

What does FAST-DS cost for a Dubai flat bought with taxed money?

If only the reporting was missed and the money was already taxed, Category 2 applies with a flat Rs 1 lakh fee. File Form 1 online with your purchase documents before the year end deadline.

Is TCS charged on every off plan instalment sent to Dubai?

TCS applies only once your total investment remittances cross the yearly limit, and then only on the amount above it. Plan instalment dates across financial years and claim the TCS back when you file.

Does a UAE Golden Visa make me an NRI for Indian tax?

No. Indian residential status depends on days spent in India and Indian income under the Income-tax Act, not on any UAE visa. A Golden Visa holder living mostly in India remains an Indian resident.

Is the 4 percent DLD transfer fee part of my cost in India?

Yes. The Dubai Land Department transfer fee is a cost of buying the flat, so it forms part of the cost of purchase when you later work out capital gains. Keep its receipt with your title deed.

Can I take an Indian bank loan to buy property in Dubai?

No. Under LRS rules, Indian banks cannot give residents loans to fund capital account remittances such as buying property abroad. The money has to come from your own funds, so plan savings before booking.

Do I report a Dubai flat I inherited from my parents?

Yes, if you are an ordinary resident. India has no inheritance tax, so receiving it costs nothing, but it must appear in Schedule FA. On sale, the previous owner's cost becomes your cost of purchase.

Will Dubai property reporting change under the Income-tax Act 2025?

The new Act covers income from 1 April 2026, so returns filed in 2027 will use new forms and section numbers. Foreign asset reporting and Black Money Act penalties continue, so keep reporting every year.
