Off Plan Payment Default in Dubai: The Law That Applies in 2026
Buyer default on off plan contracts in Dubai is governed by Article 11 of Law No. 13 of 2008 on the Interim Real Estate Register, a provision that Law No. 19 of 2020 replaced in full. The current text applies to off plan sale agreements signed before or after it took effect, and it does not cover land sales.
Why the 2020 Text Matters
The earlier 2017 wording let a developer keep up to 30% of amounts paid where work had not started for reasons beyond its control. Under the 2020 text, that situation now requires the developer to refund all payments, the same outcome as a project cancelled by RERA. Guides that still quote the 30% figure are out of date.
A Process the Contract Cannot Override
The procedure is a matter of public order. A termination that skips any step is void, and an SPA clause that gives the developer a faster route does not stand. The law lets developers act without a court order, but buyers keep the right to go to court or arbitration if a developer abuses that power.
Why More Buyers Are Checking These Rules in 2026
The data shows a cooling market. Dubai's Q3 2026 residential sales were about 38% lower in volume than a year earlier, and prices fell between 5% and 15% from the end of 2025 to September 2026. For an investor planning to sell before the next installment, a resale below the purchase price is now a real possibility, which makes the legal process more relevant than in a rising market.
