Escrow Account in Dubai Real Estate Explained: What the Law Protects
An escrow account in Dubai real estate is a bank account opened in the name of a single off plan project, managed by an escrow agent bank and used only to fund the construction of that project.
The Dubai escrow law governs these accounts, and every developer selling units off plan must follow it. Under the law, the escrow account for off plan property in Dubai receives the payments made by off plan buyers. A developer with several projects must open a separate account for each one, so money cannot move from one site to another.
4 buyer protections in the Dubai escrow law
Creditor protection. Money deposited in a project escrow account in Dubai cannot be attached by the developer's creditors. Debts from another venture cannot be settled from funds held for a buyer's building.
Access to records. Depositors or their representatives can view and copy their own accounting records held by the escrow agent. This is the most direct way for a buyer to confirm that each instalment reached the project account.
5% retention after completion. After the completion certificate is issued, the escrow agent holds back 5% of the account's total value. That amount is released to the developer 1 year after the units are registered in buyers' names.
Completion or refund duty. If a project is left unfinished, the escrow agent must consult the DLD and take steps to protect depositors, either by making sure the project is completed or by refunding their payments.
