In Dubai, the same apartment can show 2 different prices per Sq.Ft. depending on whether the developer divides by suite area or by total built up area with the balcony. Under Article 13 of Executive Council Resolution No. 6 of 2010, a buyer is owed compensation when an area shortfall exceeds 5%, and Dubai's top court counts only the part above that line. Average asking prices in Q3 2026 ranged from AED 1,054 to AED 3,490 per Sq.Ft. across key communities.

Every Dubai listing quotes a size, but not every size measures the same thing. Whether a quoted rate is fair depends on which area the number is based on: the suite area inside the unit, the total including balconies, or, for villas, the built space without the land. Comparing 2 projects without checking this can make the more expensive one look cheaper.

A buyer comparing towers should not divide one developer's price by suite area and another's by total area. A large balcony raises the total area and lowers the headline rate without adding a single square foot of indoor living space. The fix is simple: ask each developer for the suite area and the balcony area as separate figures.

This guide uses the text of Dubai's interim register regulation, a 2026 legal analysis of a Court of Cassation ruling on area shortfalls, developer floor plan definitions, Q3 2026 asking price data and the Dubai Land Department's service charge index.

Suite Area Meaning in Dubai and How It Is Measured

Suite area is the enclosed indoor area of an apartment, covering the rooms, kitchen, bathrooms and internal walls, while balconies and terraces are counted separately. Dubai floor plans often print 3 figures for each unit: suite area, balcony area and a total unit area that adds the 2 together. On one developer's studio plan, the suite measures 378.1 Sq.Ft., the balcony 95.5 Sq.Ft. and the total 473.6 Sq.Ft., so the balcony is about 20% of the quoted size.

How Developers Measure Suite Area

Developers set out the method in notes printed on their floor plans. One developer's published note measures suite area to the centre line of the walls shared with neighbouring units, to the outer face of the external walls and to the outer face of the corridor wall. Part of every wall you share with a neighbour is therefore inside your suite area.

Balcony Area in Dubai Floor Plans

The same note measures balcony area separately, to the centre line of the partition walls and to the outermost face of the balcony guard. Because the guard and wall lines are included, the usable balcony floor is slightly smaller than the stated figure. It also states that the actual area may vary and that the SPA governs the size of each unit.

Built Up Area Meaning for Apartments

Built up area, often written as BUA, is the total constructed area of a unit: the suite area plus attached balconies or terraces. Common spaces such as lobbies, corridors and lift shafts are not part of a unit's built up area.

Carpet Area vs Built Up Area for Buyers From India

Carpet area is the net floor space inside the walls, without wall thickness or balconies. It is the standard measure in India, while Dubai floor plans and SPAs work with suite area and net area instead. Buyers used to carpet area should expect the Dubai suite area to read higher for the same rooms, because the suite figure includes wall thickness.

Built Up Area vs Suite Area: Side by Side Comparison

The difference between the 2 measures is simple: suite area covers only the enclosed indoor space, while built up area adds balconies and terraces to it. The table compares the measures a Dubai buyer meets on brochures, SPAs and title deeds.

Price per Sq.Ft. in Dubai: How the Area Figure Changes the Number

The price per Sq.Ft. in Dubai changes depending on which area the price is divided by. Dividing by total area including the balcony always gives a lower figure than dividing by suite area alone, so 2 listings can look different even when the indoor space costs the same.

Worked Example: Same Apartment, 2 Prices per Sq.Ft.

Item

Figure

Sale price

AED 1,200,000

Suite area

700 Sq.Ft.

Balcony area

100 Sq.Ft.

Total built up area

800 Sq.Ft.

Price per Sq.Ft. on total area

AED 1,500

Price per Sq.Ft. on suite area

AED 1,714

The difference is about 14% on the same unit. When one developer quotes on total area and another on suite area, the tower with the larger balcony can look cheaper while costing more for every square foot of indoor space. Always convert both listings to suite area before comparing.

What the Price per Sq.Ft. Can Include Beyond Space

The same figure can also cover items that are not floor area at all. Take a studio of 380 Sq.Ft. listed from AED 649,000 at Raw District by Imtiaz in Downtown Jebel Ali, which works out to about AED 1,708 per Sq.Ft. Every residence there is delivered fully furnished with integrated kitchen appliances, so that price per Sq.Ft. also pays for furniture. Before setting it against an unfurnished unit elsewhere, ask for the suite area vs total area split of that layout so both rates use the same base.

Average Asking Price per Sq.Ft. in Dubai, Q3 2026

The data shows average asking prices in Q3 2026 of AED 3,490 per Sq.Ft. for Palm Jumeirah apartments, up 3.4% on the quarter, AED 2,158 for Business Bay apartments and AED 1,419 for apartments in Jumeirah Village Circle. Villas averaged AED 1,499 in DAMAC Lagoons and AED 1,054 in DAMAC Hills 2. These are asking prices, not completed sale prices, so treat them as a guide.

Plot Area vs Built Up Area for Villas in Dubai

For a villa, the plot area is the land and the built up area is the constructed floor space across all levels, and a Dubai villa price covers both. That is why the rate on villa BUA is not directly comparable with an apartment figure, which buys no private land.

Why the Garden Is Not in the Villa's Built Up Area

Gardens, uncovered driveways and outdoor pools are part of the plot, not the built up area. Two villas with the same BUA can stand on plots of very different sizes, and the larger plot is worth more even though the headline size is the same. Ask for both figures, and check that the plot area on the title deed matches the SPA.

Reading a Villa Listing Correctly

A villa listing shows one headline size, so it pays to ask what that size covers. The 4 bedroom villas at Oasis at Tilal Binghatti in Dubailand list a total area of 2,773 Sq.Ft. from AED 4.2 million, about AED 1,515 per Sq.Ft. of that listed area. Each villa also comes with a private garden and an optional private pool, so ask for the plot area vs built up area figures together, because the land is part of what the price pays for.

Floor space on several levels also changes how a villa size reads. A villa's built up area adds up every floor, including staircases, so 2 villas with the same BUA can have different usable room sizes if one has more stair and circulation space.

Net Area on the Title Deed and the 5% Area Difference Rule

The area registered on your title deed is the unit's net area, and Article 13 of Executive Council Resolution No. 6 of 2010 sets what happens if the finished unit differs from the area you bought. The rule applies to off plan units registered through the interim register.

What Article 13 Says About Area Differences

  • Net area is the registration basis: the net area is the figure used to register the unit, calculated as the Dubai Land Department sets.
  • A larger unit costs nothing extra: any area above the sold net area is disregarded, and the developer cannot claim payment for it unless the parties agreed otherwise.
  • Shortfall above 5% is compensated: if the actual area is more than 5% smaller than the sold net area, the developer must compensate the buyer.
  • Compensation follows the contract price: the amount is calculated using the unit price agreed in the sale agreement.
  • The SPA plan is the baseline: the net area in the sale agreement and its attached plan is the reference for any increase or shortfall.

How the 5% Area Difference Is Calculated

Dubai's Court of Cassation, in Case No. 220 of 2018, applied the rule so that the first 5% of a shortfall is not compensated. On a unit sold at AED 2,000,000 for 1,000 Sq.Ft. of net area that is delivered at 910 Sq.Ft., the shortfall is 9%. Only the 4% above the threshold counts, so compensation is AED 80,000.

Net area vs gross area matters here because the rule refers to net area, not to a gross figure that may include a share of common areas. Compare the area on your title deed with the net area in your SPA as soon as the deed is issued. If the 2 conflict, a court can appoint an expert to measure the unit.

Service Charge per Sq.Ft. in Dubai: Which Area to Ask About

Service charges in Dubai are billed per Sq.Ft. each year, so the area figure attached to your unit affects the yearly bill as much as the rate does. Rates range from AED 3 to more than AED 30 per Sq.Ft., with villas and amenity rich communities at the higher end.

The Dubai Land Department publishes approved rates in its Service Charge Index, available on its website and the Dubai REST app. Ask the developer or owners association which area figure the yearly charge is applied to, because the answer decides whether a large terrace adds to the bill.

How to Check Property Area in Dubai Before You Pay

You can check property area in Dubai with 6 quick steps before any payment, and each one relies on a document or a simple calculation.

Check 1. Ask for the floor plan with suite area and balcony area shown as separate figures, not only a total.

Check 2. Read the measurement note on the plan to see where walls and balcony guards are measured to.

Check 3. Find the net area in the SPA and make sure the attached plan matches the unit you chose.

Check 4. Divide the price by suite area for every project you compare, so all figures use the same base.

Check 5. For a villa, get the plot area in writing alongside the built up area.

Check 6. When the title deed is issued, compare its area with the SPA net area and act on any shortfall above 5%. This is non-negotiable due diligence.

Do not accept verbal confirmation of a size from a sales presentation. The SPA and its plan are the only figures that count if a dispute arises.

About the Numbers in This Guide

Legal rules come from Article 13 of Executive Council Resolution No. 6 of 2010 and a 2026 legal analysis of Court of Cassation Case No. 220 of 2018. Measurement definitions come from developer floor plan notes. Prices are average asking figures for Q3 2026. Project figures come from the project pages as updated in 2026.

Developer measurement methods can differ by project, and asking prices are not transaction prices. Check the floor plan notes and SPA for the exact unit you are buying, and look up service charge rates in the Dubai Land Department index.

The worked examples use round figures to show the method, and every calculation is shown in full in the text.

Frequently Asked Questions

Is Built Up Area the Same as Suite Area in Dubai?

No. Suite area covers only the enclosed rooms and internal walls, while built up area adds balconies and terraces on top. Ask for both figures separately whenever a listing shows only one size.

Is the Balcony Included in the Price per Sq.Ft.?

It is whenever the price is divided by total area rather than suite area. Recalculate on suite area alone to see what you actually pay for each Sq.Ft. of indoor space.

Which Area Should I Use to Compare Two Projects?

Use suite area for both, because balcony sizes can differ widely from one tower to the next. Dividing each price by suite area puts every project on the same base before you decide.

Is Villa Plot Area Included in Built Up Area?

No. Built up area is the constructed floor space across all levels, while plot area is the land, including the garden. Get both figures in writing before comparing villas in different communities.

What Happens if My Unit Is Smaller Than the SPA?

If the shortfall is above the legal threshold, the developer must compensate you for the part beyond it, based on the agreed price. Compare your title deed area with the SPA promptly.

Can a Developer Charge More if My Unit Is Bigger?

No, unless your SPA expressly allows it. The regulation says any extra area above the sold net area is disregarded and cannot be charged for. Read the area clause in the SPA before signing.

How Many Sq.Ft. Are in One Square Metre?

One square metre equals about 10.764 Sq.Ft. Some Dubai documents, including many plot figures, are given in square metres, so convert them first before comparing with a listing quoted in Sq.Ft.

Why Are Room Sizes Smaller Than the Floor Plan Suggests?

Developer floor plan notes can measure room dimensions to structural elements, excluding wall finishes such as plaster and tiles. Finished rooms can therefore measure slightly less than the figures printed on the plan.

Who Decides the Real Area in an Area Dispute?

If the SPA, the title deed and a physical measurement do not agree, a court can appoint an expert to measure the unit. Keep your SPA plan and title deed together as evidence.

How Do I Look Up the Service Charge Rate for a Unit?

Use the Dubai Land Department's Service Charge Index on its website or the Dubai REST app. You need the title deed number, issue year, property type and the year you want.
